Blog Corner: Indigenous Self-Determination and State Responsibility in International Investment

A post for EJIL: Talk! by José Saldaña examines an ICSID Award rendered on 30 June 2025 which held that Peru had breached it obligations under Canada – Peru Free Trade Agreement (FTA) for its failure to provide full protection and security as well as fair and equitable treatment to the Canadian mining company Lupaka Gold.

The award, Saldaña argues, is significant for the future of relationship between mining companies and Indigenous peoples.

Iraqi mobile operator wins ICC claim against Kuwaiti group

Korek Telecom, an Iraqi mobile operator has succeeded in ICC arbitral proceedings where it has won in a disputed loan claim worth US$500 million with a subsidiary of Kuwaiti logistics group Agility.

New UN mechanism to investigate human rights situation in Afghanistan

It has been reported that following the 48th session of the UN Human Rights Council, a new investigative mechanism has been established to investigate human rights abuses in Afghanistan and provide additional support to the mandate of the special rapporteur in the region.

The special rapporteur, Richard Bennet has stated:

The establishment of this new mechanism marks a significant milestone in the pursuit of truth, justice, and accountability for the people of Afghanistan.” 

The resolution for the new mechanism was introduced by the European Union and co-sponsored by 50 countries.

Lebanon restricts education to many refugees

The NGO, Human Rights Watch has reported that the government in Lebanon has restricted access to education for many refugees, following a continuation of a mandate that requires non-Lebanese residents to show valid residency permits or ID issued by the UN.

According to UN Children’s Fund (UNICEF), last year at least 28,000 non-Lebanese children have been prevented from accessing public education because of legal requirements.

Concern expressed by civil liberty groups on new curbs to protest in UK

It has been reported that the UK government intends to introduce new powers to police in England and Wales to restrict organisers of mass demonstrations by taking into account the “accumulative impact” of previous similar demonstrations.

Following the announcement, the pressure group Defend Our Juries has promised to escalate demonstrations in support of a proscribed group over the course of November.
